Your obligations

It is your sole responsibility to ensure you receive and read any and all digital correspondence sent from us to you. Understand the activity level of your selected escape and ensure it is appropriate to your interests and abilities before applying and paying. Prepare for the retreat by familiarising yourself with the itinerary and preparation materials provided by us. Bring appropriate gear and clothing as advised by us and as listed on the packing list provided. Follow considerate and reasonable standards of personal hygiene to reduce the risk of contracting and spreading diseases or illnesses. Follow considerate social behaviour with other trip participants and respect their habits. Act in an appropriate and courteous manner befitting the customs of the place you visit. Respect the places we visit by using environmentally safe products, disposing of litter property, and staying on established routes of travel.


Your health


You must be in good physical and mental health to participate in the retreat. You warrant you are in good physical condition and mental health, and you know of no reason why you cannot or should not do any form of active exercise, including, but not limited to, high-intensity interval training, strength training, cardiovascular training, fitness bike usage, swimming, running, hiking, yoga, stretching and sailing. Additionally, we reserve the right at any time to refuse a participant the right to participate in the retreat if escape leaders feel you are mentally or physically incapable to attend or continue and/or if a trip member's continued participation jeopardises the group or their own safety. Under these circumstances, refunds are not given.


Acknowledgement of risks


By booking with us you acknowledge all travel involves potential exposure to dangers and hazards, including equipment failures and negligence. As a consequence, these risks could result in serious injury, disability or fatality from the resulting injuries and your property may also be damaged. You assume full responsibility for any costs related to medical care and/or evacuation. You further acknowledge we may contract with independent contractors to provide any and all travel-related services and we assume no responsibility, however caused, for injury, loss or damage to person or property in connection with any service provided by an independent contractor or resulting directly from acts of God, detention, terrorism, thefts, pilferage, force majeure, civil disturbances, government restrictions or regulations, strikes, delays and expenses arising from quarantine, failure of any means of conveyance to arrive or depart as scheduled, discrepancies or change in transit or accommodation services over which we have no control.


Indemnity


By booking with us you agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s)against any injury, malpractice, mishap, or accident during any and all interactions with us away from, or at our primary place of business.


Travel insurance


It is your responsibility to organise suitable and comprehensive travel and health insurance with respect to illness, injury, death, loss of personal items, cancellation, and curtailment. You acknowledge we are not in the business of providing insurance products and cannot be held liable if your failure to arrange suitable insurance coverage leaves you exposed, medically, financially, or otherwise. You understand and acknowledge, as a condition of booking you must take out an adequate comprehensive travel and health insurance policy which covers you on your chosen retreat, as well as but not limited to, trip cancellation insurance and any other activities which may reasonably be undertaken during the course of your retreat. The policy and insurance coverage must be valid and in effect for the entire duration of your stay with us. Please note, even if you have private health insurance in your country of residence, it is unlikely this insurance will cover overseas trips to the extent required to participate in the activities organised on a trip with us. It is your responsibility to organise suitable travel and health insurance. You agree and acknowledge we are not in the business of providing insurance products or providing cover for or on behalf of guests and we are not to be held liable.


Cancellations


Naturally, no one books with the intention of cancelling or postponing their trip, but unexpected things do happen, so you must have adequate travel cancellation insurance in place before booking your retreat/experience with us. If you need to cancel any booking, cancellation fees will apply. Any notice of cancellation must be provided in writing and all transaction fees from our payment gateway will be deducted from your refund. If you cancel 90 days or more before the start date of your retreat, you will be refunded the full amount paid up to that date, minus any transaction fees imposed by our payment gateway and excluding the deposit paid per person, which is non-refundable, unless the space can be replaced. If you cancel between 60-90 days before your start date, you will be refunded 50% of any sums paid, minus any transaction fees imposed by our payment gateway and excluding your deposit per person, which is non-refundable, unless the space can be replaced. Cancellations less than 60 days before the start date are non-refundable and will result in a forfeit of any and all sums paid. Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made for any reason.


Cancellations by us


We reserve the right to make reasonable changes in the itinerary where deemed advisable for the comfort and well-being of escape participants. We reserve the right to make changes to any aspect of the retreat if, in our absolute and sole discretion of us, it is necessary to do so due to conditions which may be hazardous or dangerous or due to any other adverse or threatening conditions such as COVID-19, weather, political, military, terrorist or otherwise or any other reason considered necessary by us. If we are prevented from performing any of our obligations under these terms and conditions by acts of God, strikes, trade disputes, fire, weather, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside our reasonable control, we will be under no liability whatsoever to you and may either cancel or postpone the escape. If for any reason we have to cancel or change the start date of any retreat, for any reason whatsoever, you’re entitled to transfer the sums paid to another one of our retreats (either scheduled or at a future date within the next 2 years) to be used as credit. Alternatively, you may request a refund of payments made by you to us. We are not responsible for any of your expenses incurred in preparation for any cancelled escapes/experiences such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip. The retreat price is quoted as a package, credits and refunds are not given for any services not used, including but not limited to, unused rooms, meals, drinks, boat trips, activities, workouts or hiking arrangements.


Passport Visa and Documents


It is the responsibility of each client to obtain a valid passport, visa(s) and necessary certificates for any country to be visited in connection with any of our retreats.


Third parties


We hold no responsibility for the actions or omissions of third parties or independent contractors, including in the event they modify the nature of a service on a retreat as compared with the advertised nature of the service. We accept no responsibility for delayed, missed or cancelled flights, buses, ferries, transfers, or any other modes of transportation required by you to get to your accommodation, or any other activity or event in connection with or relating to your retreat.


General waiver


By booking with us you acknowledge during any trip with us, you participate voluntarily in any and all activities arranged. You acknowledge to surrender your right to any cause of action against us, our agents, contractors, employees and directors, arising from any loss or damage to any person or property that occurs during an escape/experience with us up to and including death.


Release of liability, assumption of risk and indemnification of risk


By booking with us you have chosen to participate in the retreat which is organised by the company, and you understand the following. During the retreat, you may be exposed to dangers and hazards, including equipment failures and negligence by others. As a consequence of these risks, you may be seriously or fatally hurt from the resulting injuries, and your property may also be damaged. Hospital facilities, qualified medical care, and emergency medical evacuation may be limited or unavailable during portions of the retreat and where available, may be expensive. The company assumes no responsibility for providing medical care during the retreat, and you will have to pay for any medical care and/or evacuation you incur. In consideration of the permission to participate in the retreat, you agree to the terms and conditions contained in this document.


Assumption of risk


By booking with us you hereby freely assume the above-mentioned risks and any harm, injury or loss which may occur to you or your property as a result of your participation in the retreat, including any and all risks caused by the negligence of the company, its employees and officers, its contractors, and other retreat participants.


Waiver and release of liability


By booking with us you hereby WAIVE AND RELEASE ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS against the company, its employees, officers, directors, vendors and contractors (“released parties”) where such LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS arise in any way from any injury, death, loss or harm (foreseen or unforeseen) which occur to you or to any other person or to any property during the escape/experience or are in any way related to the retreat. This release includes, but is not limited to, claims for the negligence of the released parties and claims for strict liability for abnormally dangerous activities. You also agree NOT TO SUE or make a claim against the released parties for death, injuries, loss, or harm that occur on the retreat.


Indemnification to hold harmless and defence


By booking with us you promise to INDEMNIFY, WARRANT, HOLD HARMLESS AND DEFEND the released parties against any and all LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS which arise from your acts or your failure to act (including your own negligence) during or relating to the retreat. In accordance with this promise, you will reimburse the released parties for any damages, reasonable settlements, and defence costs, including attorney's fees, they incur because of any such claims made against them. You agree in the event of your death or disability, the terms of this agreement, including the indemnification obligation in this section, will be binding on your estate, and your personal representative, executor, administrator, or guardian will be obligated to respect and enforce them.


Severability


By booking with us you agree the purpose of this agreement is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by UK and Spanish law. You agree if any portion or provision of this agreement is found tobe invalid or unenforceable, then the remainder will continue in full force and effect. You also agree any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement
